MOD5 is a registered business name of Division 22 Pty Ltd (ABN 85 670 745 838). In this policy, “MOD5”, “we”, “us” and “our” mean Division 22 Pty Ltd trading as MOD5.

2. Scope
This policy explains how MOD5 handles personal information in connection with its website, wholesale enquiries, trade applications, sample requests, installer program, product support and related business dealings.
We handle personal information in accordance with the privacy, communications and other laws that apply to us. Whether every provision of the Privacy Act 1988 (Cth) and the Australian Privacy Principles applies to MOD5 depends on statutory thresholds, activities and exceptions. This policy does not represent that their application has been conclusively determined.
3. Information we may collect
Depending on how you interact with us, we may collect:
- business name, business type and ABN;
- contact name, role, email address, phone number and location;
- website or social-media profile;
- installation experience, training and product interests;
- trade-access, sample, product and Founding Installer enquiry details;
- quotation, order, delivery, payment and account records;
- product support, defect, return and warranty information;
- vehicle details, photographs or other files you choose to provide through correspondence or a support process;
- communications between you and MOD5;
- the source page, date and generated reference associated with an enquiry; and
- device, browser, IP address, referring page, website interactions, cookie identifiers and similar technical information.
The current website enquiry form does not provide a dedicated image-upload field. Images may nevertheless be collected if you later send them through an authorised support or correspondence channel. Please avoid supplying personal information that is unnecessary for your enquiry.
4. Required and optional information
Fields marked as required are needed to assess and respond to an enquiry. If required information is not provided, we may be unable to process the enquiry or evaluate trade access.
Optional fields, including an ABN or website or social profile where marked optional, help us understand the business but are not required for initial submission.
5. How we collect information
We may collect information:
- directly from you through the website, email, phone or other correspondence;
- from an authorised representative of your business;
- from publicly available business sources;
- through our hosting, security, analytics and advertising technologies; and
- from service providers involved in an enquiry, order, delivery, payment, support or claim.
If you provide another person’s information, you must be authorised to do so and should make them aware of this policy where reasonable.
6. How we use information
We may use personal information to:
- receive, assess and respond to trade, product, sample and installer enquiries;
- verify business eligibility and administer trade access;
- prepare quotations, confirm orders and administer accounts;
- arrange supply, freight, product support, returns and warranty claims;
- communicate about a transaction or requested service;
- maintain security, prevent fraud and troubleshoot the website;
- understand website use and measure production advertising performance;
- maintain business, tax, warranty and legal records;
- resolve disputes and complaints; and
- comply with applicable law.
We do not sell personal information.
7. Direct marketing
Consent to process an enquiry is not consent to receive direct marketing. We will send marketing communications only where the recipient has separately opted in or otherwise specifically authorised them.
Marketing messages will identify MOD5, provide appropriate sender details and include a functional unsubscribe method. We will action unsubscribe requests within the period required by applicable law. Transactional, account, product-safety, order, support and enquiry-response messages are not marketing merely because they concern MOD5 products.
8. Service providers and disclosures
We may disclose information where reasonably necessary to:
- Vercel, which hosts the Next.js website and server functions;
- Supabase, which provides enquiry processing and database services;
- an email-delivery provider and MOD5’s business mailbox provider;
- freight, logistics and fulfilment providers;
- payment, accounting and professional-service providers used for an accepted transaction;
- Google Analytics 4, Google Ads and Metricool for production website measurement;
- security, technical-support and fraud-prevention providers;
- regulators, courts, law-enforcement bodies or other persons where required or authorised by law; and
- a buyer or adviser involved in a proposed business transaction, subject to appropriate confidentiality arrangements.
We disclose only information reasonably required for the relevant purpose.
9. Overseas processing and disclosure
Some providers operate infrastructure or engage subprocessors in Australia and overseas. As a result, personal information or technical information may be processed, stored or accessed outside Australia. The exact locations can depend on provider infrastructure, project region, account configuration and subcontracting arrangements.
Our relevant providers may include Vercel, Supabase, email-service providers, Google and Metricool. Their handling of information is also governed by their contracts, privacy commitments and applicable laws. Where applicable law requires us to take particular steps before an overseas disclosure, we will take those steps.
10. Enquiry and data flow
When an enquiry is submitted:
- the browser sends the enquiry to the MOD5 website hosted by Vercel;
- the MOD5 server validates the submission and generates an enquiry reference;
- the submission is sent to MOD5’s dedicated Supabase enquiry function;
- the enquiry is stored in MOD5’s Supabase database;
- an email notification is sent to MOD5 through the configured email service; and
- authorised MOD5 personnel can review the enquiry through a protected inbox.
The protected inbox requires authentication and is not intended for public access.
11. Analytics, advertising and cookies
The production website uses:
- Google Analytics 4;
- the Google Ads tag; and
- Metricool.
These services may use cookies, pixels, scripts, local storage or similar technologies and may receive device, browser, IP address, referring-page, interaction and identifier information. The services help us understand website use, diagnose performance and measure advertising outcomes. Their operators may process information under their own privacy policies.
You can use browser settings and provider controls to block or delete cookies. Blocking technologies may affect some website functions or measurement. Preview and development deployments are intended not to load production analytics integrations.
12. Storage and security
We take reasonable technical and organisational steps to protect information, including access controls for the enquiry inbox and restricted service credentials. No internet transmission or storage system is completely secure. You should not send sensitive or unnecessary information through a general enquiry form.
If a data incident occurs, we will investigate it and take notification or remedial steps required by applicable law.
13. Retention
We generally retain an enquiry for up to 24 months after the last meaningful interaction.
If the enquiry leads to a quotation, account, order, dispute, product-support matter or warranty claim, relevant records may be retained longer where reasonably required for the transaction, taxation, accounting, insurance, warranty, dispute-resolution or legal purposes.
We may retain de-identified information where it no longer identifies an individual. When information is no longer reasonably required, we will take reasonable steps to delete or de-identify it, subject to backup and legal-record requirements.
14. Access and correction
You may ask to access or correct personal information we hold about you by contacting info@mod5.com.au. We may need to verify your identity. We will respond within a reasonable period and explain any lawful reason for refusing or limiting a request.

We may update this policy when our website, providers, practices or applicable obligations change. The current version and update date will be published on the website.
